Agreement to Terms

Welcome to Expenny! These Terms of Service ("Terms") govern your access to and use of the Expenny mobile application (the "App") provided by Vitalii Kikot ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

Expenny is an expense tracking application that allows you to:

• Track and manage personal expenses
• Organize expenses into categories
• Use AI-powered features to parse expenses from text, audio, and images
• Access premium features through subscription plans

Account & Authentication

Device-Based Authentication

The App uses device-based anonymous authentication. When you first use the App, a unique account is created based on your device identifier. This allows you to use the App without creating a traditional username and password.

Social Account Linking

You may optionally link your account to a social login provider (Google, Apple, or Facebook). When you link a social account:

• Your email, name, and profile avatar may be associated with your account
• You can access your data across multiple devices
• Account Merging: If you link a social account that uses an email address already associated with another Expenny account, your accounts may be merged

Account Security

You are responsible for maintaining the security of your device and all activities that occur through your account.

Billing

• Subscriptions are billed through the Apple App Store or Google Play Store

Cancellation

• Cancel your subscription at any time through your App Store or Play Store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods

User Responsibilities

Acceptable Use

You agree to use the App only for lawful purposes. You shall not:

• Use the App to track illegal activities or transactions
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or servers
• Misuse AI features by submitting harmful or inappropriate content
• Circumvent any usage limits or restrictions

AI Feature Usage

When using AI-powered features, you acknowledge that:

• AI parsing may not always be 100% accurate
• You are responsible for reviewing and correcting AI-generated expense data
• Content submitted for AI processing is sent to third-party services (Google Gemini)

Intellectual Property

Our Intellectual Property

The App and its original content, features, and functionality are owned by Vitalii Kikot and are protected by international copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of the expense data, categories, and other content you create in the App. By using the App, you grant us a limited license to store and process your content to provide the App's services.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device
• Use the App for your personal, non-commercial expense tracking purposes

License Restrictions

You shall not:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Remove or alter any proprietary notices on the App

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

AI Accuracy

We do not warrant that AI-powered expense parsing will be 100% accurate. You are solely responsible for reviewing and verifying all AI-generated expense data.

Financial Decisions

THE APP IS A PERSONAL EXPENSE TRACKING TOOL AND DOES NOT PROVIDE FINANCIAL, TAX, OR LEGAL ADVICE. We are not responsible for any financial decisions you make based on data in the App.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Vitalii Kikot SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Any damages arising from AI processing errors

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

Termination

By You

You may stop using the App at any time by uninstalling it from your device.

By Us

We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms or engage in fraudulent or illegal activity.

Effect of Termination

Upon termination, your license to use the App immediately ends. We may delete your account and data, subject to legal retention requirements.

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Ukraine.

Informal Resolution

Before filing any legal claim, you agree to try to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days.
